Creditors of Charter Co. have told a federal appeals court in Jacksonville, Fla., that a bankruptcy judge should not have allowed the transfer of millions of dollars among Charter and its 179 subsidiaries. A three-judge panel of the U.S. 11th Circuit Court of Appeals heard the arguments from attorneys for Prudential Insurance Co. and eight other institutions seeking to overturn a cash-management plan approved by Bankruptcy Judge George Proctor. Prudential and the others had lent Charter subsidiaries about $215 million before Charter and 43 of the units filed for protection under Chapter 11 of the U.S. Bankruptcy Code.
