Lawsuit Filed Against City in Fatal Trash Truck Crash

The mother of an 8-year-old boy killed by a malfunctioning trash truck filed suit Thursday against the city of Los Angeles.
The lawsuit was filed in Los Angeles Superior Court by Maria C. Serrano, mother of Brian Serrano, one of two boys killed Dec. 6 when the malfunctioning hydraulic piston of a city trash truck crashed into the school bus in which the youngsters were riding near downtown. Serrano’s lawsuit is the first filed in connection with the fatal accident.
Named as defendants in the suit are the city of Los Angeles, Kenneth Wayne Fox, driver of the truck, and David Wear, the supervisor who has since been fired for letting the truck onto the streets even though it had been flagged for mechanical problems.
The suit does not specify a monetary amount, but in a claim filed with the city Dec. 14, Serrano asked for $25 million. City officials could not be reached for comment.
