An attorney for Mary Beth Whitehead asked the New Jersey Supreme Court to block Superior Court Judge Harvey R. Sorkow’s decision that upheld the surrogate contract under which Baby M was born. The decision also stripped Whitehead of her parental rights and awarded custody to biological father William Stern. Attorney Harold J. Cassidy asked the court to grant Whitehead visitation rights to the daughter she bore under the contract. A three-judge panel in the Appellate Division of Superior Court has denied Whitehead’s request for a stay.
