Judge Declares Mistrial in Cigarette Lawsuit: Six jurors deliberated for 21 hours without reaching a verdict in an Indiana case. Yvonne and Richard Rogers sued four tobacco companies in 1987, claiming they caused him to contract lung cancer. When he died later that year at 52, his widow amended the suit to include charges of wrongful death. After the mistrial was declared, Yvonne Rogers and her attorney predicted victory in a second trial. The case was the first to go to trial since last spring’s congressional hearings at which witnesses testified that tobacco officials knew nicotine was addictive and hid that information from the public.
